1.0 Purpose
The purpose of this policy is to ensure Baker College complies with the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (The Jeanne Clery Campus Safety Act), codified at 20 U.S.C. § 1092(f). This policy establishes institutional requirements for crime reporting, emergency notifications, and publication of safety information, reflecting the College's commitment to a safe and secure campus environment.
2.0 Definitions
Annual Security and Fire Safety Report – A report containing statistics of Clery crimes and certain fire safety statistics for the three most recent calendar years as well as college policy statements and procedures addressing campus security and fire safety on Baker’s Clery geography.
Campus Security Authority (CSA) – An individual who meets one of the following definitions: a) any individual who has responsibility for campus safety; b) any individual or organization specified as an individual to which students and employees should report criminal offenses; or c) an official of an institution who has significant responsibility for student and campus activities.-An “official” is defined as any person who has the authority and duty to take action or respond to a particular issue on behalf of the institution.
Clery Crimes – Crimes designated as reportable under the Clery Act, which include:
- Criminal Offenses – murder and non-negligent manslaughter, manslaughter by negligence, sexual assault (rape, fondling, incest, and statutory rape), robbery, aggravated assault, burglary, motor vehicle theft, and arson.
- Hate Crimes – any of the above-mentioned Criminal Offenses and any incidents of larceny-theft, simple assault, intimidation, or destruction/damage/vandalism to property that were motivated by bias.
- Violence Against Women Act (VAWA) Offenses – domestic violence, dating violence, and stalking.
- Weapons, Drug, and Liquor Law Violations – arrests and referrals for disciplinary action.
Clery Geography – Buildings and properties on each separate campus considered to be:
- “On Campus” – buildings or property owned or controlled by Baker College within the same reasonably contiguous geographic area; or buildings or property within the same reasonably contiguous areas, owned by the institution but controlled by another person, frequently used by students, and supporting educational purposes.
- “Non-Campus Building or Property” – building or property owned or controlled by the College that is used in direct support of, or in relation to, the College’s educational purposes, is frequently used by students, and is not within the reasonably contiguous geographic area of the College; or building or property owned or controlled by a registered student organization.
- “Public Property” - thoroughfares, streets, sidewalks, and parking facilities that are within the campus or immediately adjacent to and accessible from the campus.
- “Separate Campus” - Additional location that (a) the institution owns or controls, (b) is not reasonably geographically contiguous with the main campus, (c) has an organized program of study, and (d) there is at least one person on-site acting in an administrative capacity.
Emergency Notification – Notification to the campus community upon confirmation of a significant emergency or dangerous situation involving an immediate threat to the health or safety of students or employees occurring on campus.
Timely Warning – Notification to the campus community of Clery crimes that occur on Baker College’s Clery geography and represent a serious or continuing threat to the safety of students or employees.
3.0 Scope
This policy applies to all Baker College campuses and locations, including all areas defined as part of the institution’s Clery geography.
4.0 Policy Statement
Baker College affirms its commitment to transparency, accountability, and the safety of its campus communities by fully complying with all requirements of the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (The Jeanne Clery Campus Safety Act) and its implementing regulations. This includes the accurate reporting of campus crime statistics, the issuance of timely warnings and emergency notifications, and the annual publication of the College’s Security and Fire Safety Report. Through these efforts, the College ensures that students, employees, and the public have access to critical information about campus safety.
5.0 Procedures
Baker College will implement the following procedures to ensure compliance with the The Jeanne Clery Campus Safety Act:
Annual Requirements
The College will:
- Provide training to all designated Campus Security Authorities (CSAs) on their responsibilities related to crime reporting under the The Jeanne Clery Campus Safety Act.
- Collect and compile Clery-reportable crime statistics from CSAs and relevant law enforcement agencies.
- Submit crime and fire statistics to the U.S. Department of Education as required.
- Publish the Annual Security and Fire Safety Report by October 1 each year. This report will include:
- Crime statistics for the past three calendar years;
- Fire safety statistics for on-campus student housing;
- Relevant campus safety policies and procedures.
- Notify all current students and employees of the availability of the Annual Security and Fire Safety Report no later than October 1, and again during the spring semester.
- Provide ongoing crime prevention and awareness programs to students and employees.
Ongoing Requirements
The College will:
- Maintain and implement missing student notification procedures for on-campus student housing facilities.
- Develop, maintain, and test emergency response and evacuation procedures to ensure timely and effective responses to campus emergencies.
- Issue Timely Warnings and Emergency Notifications to the campus community, as appropriate, in response to Clery-defined crimes or significant threats to safety.
- Maintain a daily crime and fire log, where applicable, and make it available for public inspection as required by law.
- Monitor and comply with any additional The Jeanne Clery Campus Safety Act requirements issued by the U.S. Department of Education, including updates to reporting criteria, definitions, or procedural mandates.
