1.0 Purpose
The Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (Clery Act), codified at 20 U.S.C.1092(f), requires institutions participating in federal financial aid programs to meet certain safety-related obligations. Baker College is committed to ensuring a safe campus environment in compliance with the Clery Act.
2.0 Definitions
Annual Security and Fire Safety Report – A report containing statistics of Clery crimes and certain fire safety statistics for the three most recent calendar years as well as college policy statements and procedures addressing campus security and fire safety on Baker’s Clery geography.
Campus Security Authority (CSA) – An individual who meets one of the following definitions: a) any individual who has responsibility for campus safety; b) any individual or organization specified as an individual to which students and employees should report criminal offenses; or c) an official of an institution who has significant responsibility for student and campus activities.-An “official” is defined as any person who has the authority and duty to take action or respond to a particular issue on behalf of the institution.
Clery Crimes – Crimes designated as reportable under the Clery Act, which include:
- Criminal Offenses – murder and non-negligent manslaughter, manslaughter by negligence, sexual assault (rape, fondling, incest, and statutory rape), robbery, aggravated assault, burglary, motor vehicle theft, and arson.
- Hate Crimes – any of the above-mentioned Criminal Offenses and any incidents of larceny-theft, simple assault, intimidation, or destruction/damage/vandalism to property that were motivated by bias.
- Violence Against Women Act (VAWA) Offenses – domestic violence, dating violence, and stalking.
- Weapons, Drug, and Liquor Law Violations – arrests and referrals for disciplinary action.
Clery Geography – Buildings and properties on each separate campus considered to be:
- “On Campus” – buildings or property owned or controlled by Baker College within the same reasonably contiguous geographic area; or buildings or property within the same reasonably contiguous areas, owned by the institution but controlled by another person, frequently used by students, and supporting educational purposes.
- “Non-Campus Building or Property” – building or property owned or controlled by the College that is used in direct support of, or in relation to, the College’s educational purposes, is frequently used by students, and is not within the reasonably contiguous geographic area of the College; or building or property owned or controlled by a registered student organization.
- “Public Property” - thoroughfares, streets, sidewalks, and parking facilities that are within the campus or immediately adjacent to and accessible from the campus.
- “Separate Campus” - Additional location that (a) the institution owns or controls, (b) is not reasonably geographically contiguous with the main campus, (c) has an organized program of study, and (d) there is at least one person on-site acting in an administrative capacity.
Emergency Notification – Notification to the campus community upon confirmation of a significant emergency or dangerous situation involving an immediate threat to the health or safety of students or employees occurring on campus.
Timely Warning – Notification to the campus community of Clery crimes that occur on Baker College’s Clery geography and represent a serious or continuing threat to the safety of students or employees.
3.0 Scope
This policy applies to all Baker College locations and Clery geography.
4.0 Policy Statement
Baker College will comply with all requirement of the Clery Act and its regulations.
5.0 Procedures
On an annual basis, Baker College will:
- Provide CSA training on crime reporting obligations
- Collect and compile Clery crime reports from CSA's and law enforcement.
- Submit crime and fires statistics to the Department of Education and publish the Annual Security and Fire Safety Report by October 1, which includes safety policies, crime statistics, fire data and relevant procedures.
- Notify students and employees of the availability of the Annual Security Report on or before October 1 and again during the spring semester.
- Offer crime prevention and awareness programs.
Ongoing Baker College will:
- Maintain missing student notification procedures for on campus student housing.
- Ensure emergency response and evacuation procedures are in place.
- Issue Timely warnings and Emergency Notifications when appropriate.
- Maintain a daily crime and fire log (where applicable) for public inspection.
Baker College will meet other operational and reporting Clery Act requirements as set by the Department of Education.
6.0 Responsibilities
Campus Safety Directors
Campus Safety Directors will be responsible for the collection and reporting of Clery Act related data.
